A Small Malaysian curry house has won a battle against fast food giant McDonald's, winning the right to call itself McCurry Restaurant. The latest bid by the Chicago-based company to protect its trademark was rejected by Malaysia's highest court after it had appealed against a similar ruling earlier this year.

The court ruled yesterday the US fast food giant could not appeal against another court's verdict that allowed McCurry to use the "Mc" prefix.

The ruling by the Malaysian Federal Court ends all legal avenues for McDonald's to protect its name from what it said was a trademark infringement. The success of the Malaysian McCurry restaurant mirrors a similar decision in Britain on a case that ran for nine years.
